  10. LICENSE AGREEMENT

  12. Please read and understand this license agreement fully before 
  13. using the xStarter v 1.xx software (also referred to in this 
  14. agreement as 'the software', 'this software' or 'xStarter'). 
  15. This is an agreement between you, the end-user, and xStarter 
  16. Solutions, Inc., the publisher of the xStarter software. By 
  17. installing and/or using this software you are agreeing to be 
  18. bound by the terms of this agreement.

  20. IF YOU DO NOT AGREE WITH THE TERMS OF THIS LICENSE AGREEMENT, 
  21. THE SOFTWARE MUST BE REMOVED, INCLUDING ANY INSTALLATION 
  22. FILES AND ARCHIVAL FILES.

  24. You shall not modify, reverse engineer, decompile or disassemble 
  25. the software or any part thereof or otherwise attempt to derive 
  26. source code or create derivative works therefrom. You are not 
  27. allowed to remove, alter or destroy any copyright markings or 
  28. notices placed upon or contained with the software.

  31. TRIAL VERSION

  33. The trial version of this software may be used for evaluation 
  34. purposes at the user's own risk for a period of 30 days from 
  35. the date of installation. At the end of the trial period, the 
  36. user must either purchase a license to continue using the 
  37. software, or remove it from his/her system.
  38.  
  39. The trial version may be freely distributed, provided the 
  40. distribution package is not modified. Anyone can distribute 
  41. trial version of xStarter on any Cover Disk or CD-ROM without 
  42. any permission (just inform us by E-mail).

  44. No person or company may charge a fee for the distribution of 
  45. xStarter without written permission from the copyright holder.

  48. Licensed Version

  50. On payment of the appropriate license fee, the user is granted 
  51. a non-exclusive license to use xStarter on one computer (i.e. 
  52. a single motherboard), for any legal purpose, at a time. The 
  53. registered software may not be rented or leased, but may be 
  54. permanently transferred, if the person receiving it agrees to 
  55. terms of this license. If the software is an update, the transfer 
  56. must include the update and all previous versions.

  59. Warranty and damages

  61. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE 
  62. SOFTWARE AND DOCUMENTATION ARE PROVIDED "AS IS" AND 
  63. XSTARTER SOLUTIONS, INC. DISCLAIMS ALL OTHER WARRANTIES 
  64. AND CONDITIONS, EITHER EXPRESS OR IMPLIED, INCLUDING, 
  65. BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, 
  66. FITNESS FOR A PARTICULAR PURPOSE, CONFORMANCE WITH 
  67. DESCRIPTION, TITLE AND NON-INFRINGEMENT OF THIRD PARTY 
  68. RIGHTS.

  70. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN 
  71. NO EVENT SHALL XSTARTER SOLUTIONS, INC. BE LIABLE FOR 
  72. ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR 
  73. EXEMPLARY DAMAGES OR LOST PROFITS WHATSOEVER (INCLUDING, 
  74. WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, 
  75. BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, 
  76. OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OR 
  77. INABILITY TO USE THE SOFTWARE PRODUCT, EVEN IF XSTARTER 
  78. SOLUTIONS, INC. HAS BEEN ADVISED OF THE POSSIBILITY OF 
  79. SUCH DAMAGES. IN ANY CASE, XSTARTER SOLUTIONS'S 
  80. CUMULATIVE AND ENTIRE LIABILITY TO YOU OR ANY OTHER 
  81. PARTY FOR ANY LOSS OR DAMAGES RESULTING FROM ANY CLAIMS, 
  82. DEMANDS OR ACTIONS ARISING OUT OF OR RELATING TO THIS 
  83. AGREEMENT SHALL NOT EXCEED THE PURCHASE PRICE PAID FOR 
  84. THIS LICENSE.

  86. YOU ACKNOWLEDGE THAT THE SOFTWARE IS NOT INTENDED FOR 
  87. USE IN ON-LINE CONTROL OF AIRCRAFT, AIR TRAFFIC, 
  88. AIRCRAFT NAVIGATION OR AIRCRAFT COMMUNICATIONS; IN THE 
  89. DESIGN, CONSTRUCTION, OPERATION OR MAINTENANCE OF ANY 
  90. NUCLEAR FACILITY OR ANY ANOTHER SYSTEMS FROM WHICH 
  91. DEPENDS LIFES OR SAFETY OF PEOPLE.
